EPC legislation.

The government has announced that with effect from 1st July, 2011, the following changes will be made to the EPC legislation under the Energy Performance of Buildings Regulations. These changes will affect all properties put on the market for sale or rental after this date.

  • The EPC will now be required within 7 days of the start of marketing for all properties put on the market after 1st July.
  • Trading Standards Officers will have increased powers of enforcement to ensure properties being marketed have an EPC in place. These powers to require production of the documents will be extended to include persons acting on behalf of the seller or landlord – e.g. estate agents and letting agents.
  • Agents in both the residential and commercial market will be responsible for ensuring an EPC is available.
  • From 1st October, 2011, all agents must ensure that the full EPC is included in all marketing material, including the sales particulars.

The cost of making energy improvements, reducing fuel bills and adding value to your home could be much less than you think! Government is supporting action to help reduce CO2 emissions, including: an obligation on energy suppliers to promote energy saving measures, encouragement to local authorities to implement energy saving strategies and the introduction of Energy Performance Certificates on the sale of homes. They provide a wide range of financial support, incentives and offers to help you with the costs

Landlords require Energy Performance Certificates from 1 October 2008

From October 2008 the government decided to introduce the rented property EPC. All rented properties in both the social and private sectors in England and Wales will be legally required to present an EPC to all prospective tenants. The EPC scheme was brought in by the government to help potential buyers understand the homes energy efficiency by rating the home using a scale from A-G.
‘A’ rated homes indicate they are the most efficient homes and should have the lowest fuel bills. It also lets the potential buyer know the impact that particular property has on the environment; an EPC will also include recommendations on ways to improve the home’s efficiency to save the buyer money and help the environment.

The National Approved Letting Scheme (NALS) welcomes the introduction of EPC’s for Landlords saying it’s a win-win situation for everyone. Caroline Pickering, chair of the NALS explains “An EPC provides the tenant with a clear indication of the energy efficiency of their accommodation which can only be a selling point for prospective tenants".

Landlords can implement new energy saving measures before under taking the EPC to help credit its rating. These simple yet effective ways ensure their properties are as energy efficient as possible ahead of the EPC.
These can range from installation of double glazing to cavity wall and loft installation. Landlords could even replace old boilers which when older than 15 years old prove to be less energy efficient.

It is strongly recommended that Landlords contact a local Domestic Energy Assessor (DEA) ahead of the October deadline to avoid having to join a waiting list and most importantly put you ahead of competition. Landlords can get a free instant quote for Energy Performance certificate (EPC’s)

When buildings are to be rented out, the landlord is responsible for ensuring a valid certificate is made available to all prospective tenants. The EPC report must be made available to all tenants at the earliest opportunity possible, with all costs being covered by the landlord. Prospective tenants are to receive the EPC free of charge and no later than:
• when any written information about the building is provided in response to a request for information received from the prospective tenant; or
• when a viewing is conducted; or
• if neither of those occur, before entering into a contract to sell or let

Landlords are not obliged to make the EPC available where:

  • The landlord doesn’t believe there is a genuine interest from the prospective tenant or feels they are unlikely to have sufficient funds to rent the property.
  • The landlord is not prepared to rent out the property to the prospective tenant (although this does not authorise unlawful discrimination).

    The requirement is being introduced to comply with the EU’s Energy Performance of Buildings Directive (EPBD) which applies to all properties. Energy Performance Certificates (EPC) not only tell you how energy efficient a home is on a scale of A-G but also tells you, on a scale of A-G, about the impact the property has on the environment. The average property in the UK currently has a rating in bands ‘D-E’, with rating ‘A’ being the ideal target.

    The EPC also gives you recommendations on how to improve the rating, not only to benefit the effect on the environment but to help homeowners save money on energy bills. Factors such as age, size, location and condition of the property will all affect its rating. The recommendations made in the EPC will also consider these factors before tailoring suitable energy saving suggestions to each property.
